           Sub: Disposal of service representations on fixation of seniority in the Inspector cadre – N.R.Parmar case – Reg.

           Please refer to minutes of the JCM/GRM held on 07.08.2014 and the points sponsored by the Association on JCM/GRM held on 08.10.2015 and 24.10.2016.
A number of representations regarding re-fixation of the seniority in the cadre of Inspectors were submitted by many officers based on the Hon’ble Supreme Court judgement in N.R Parmar & Ors Vs Union of India. Though more than 3 years had passed no action has been taken to dispose of these representations so far. In the JCM/GRMheld on 07.08.2014, though assurance was given on implementation of the decision by September 2014 and minuted in the meeting, no further action was taken. It is brought to your kind notice that many CCA’s including Kolkata, Vadodara, Shillong, Delhi, Mumbai Customs under the CBEC has already implemented the decision of the Hon’ble Supreme Court in the said case. The other Zones including Chennai have initiated the process for re-fixation of the seniority as CBEC had given direction to submit the compliance report on implementation by 30.11.2016. The Commissioner of Customs, Kochi Custom House has also vide letter F.No S45/53/2014 Estt Cus dated 29.11.2016 given directions to refix the seniority from 1986 onwards. Copies of the relevant documents are enclosed for ready reference.  Hence it is once again requested that necessary directions may kindly be given for implementation of the Hon’ble Supreme Court judgement in the said case by constituting a team headed by a Group A officer and we offer our unsolicited support including nominating officers well versed in the issue for implementation of the case.
