Meeting with Chief Commissioner on 14th September, 2015 at Cochin

Dear Comrades,

The office bearers of All India Central Excise Inspectors Association, Kerala Circle, comprising Com.Prabodh S (President), Com.Biju P.Raphael (Joint Secretary-South) and myself met the Chief Commissioner on 14th September, 2015 at Cochin. The Commissioner of Central Excise, Cochin Commissionerate, the Commissioner of Customs (Preventive) and Additional Commissioner (CCO) were also present during the meeting. The following issues pertaining to the cadre were discussed with the Chief Commissioner:
  1. The Inter Zonal Transfer (IZT) and relief of officers affected by the department appeal in the High Court of Kerala:
We requested the Chief Commissioner to relieve the affected officers, who had been granted IZT, at the earliest. The Chief Commissioner informed us that the copy of the High Court judgement has not been received so far and appropriate action would be taken once the copy of the judgement is received officially. We apprised the Chief Commissioner of the batch of Inspectors joining before October 31st and the seniority would be affected if the relief is delayed. We also brought to his notice that the fresh batch of IZT applications may kindly be considered as well, as the High Court judgement pertained to relief of officers who were already granted the transfer and not regarding forwarding of application. However the Chief Commissioner told that all the decisions pertaining to Inter Zonal Transfer would be taken by him once the official copy of the judgment of Hon’ble High Court of Kerala on IZT is received by him.
  1. Inspectors being asked to do Ministerial work:
The office bearers also informed him of the situation wherein the promoted officers are being asked to do Ministerial work by the administration. The Chief Commissioner opined that this is due to the effect of the cadre restructuring and large number of promotions but department is taking steps to get the vacancy filled. The Association specifically pointed out that the administration had not reported the vacancy of the Tax Assistants to SSC for the Combined Graduate Level Examination, 2013. The Chief Commissioner has assured us that the matter of non-reporting of vacancy would be looked into.
  1. The issues in connection with AP/UB:
The situation of officers continuing beyond the tenure of posting in AP and UB in Kozhikode and Thiruvananthapuram, as well as issues arising out of dual control of transfer and posting was brought to the notice of the Chief Commissioner. The Chief Commissioner has agreed to look into the matter.
  1. The distribution of resources across Commissionerates:
The office bearers informed the Chief Commissioner of unequal distribution of resources in both Executive as well as Ministerial cadre in different Commissionerate, which affects the officers working in those Commissionerates. On this point also the Chief Commissioner has informed us that a suitable action would be taken after due deliberation.
  1. Letter from The Cochin administration seeking letter of recognition and bye law from the Association:
We informed the Chief Commissioner that the letter from Establishment, Cochin seeking letter of recognition and constitution from the Association is unnecessary and sought to know the intention of the administration. The Chief Commissioner in a lighter vein remarked that as the Association is duly recognised, there is no harm in giving the letter and that getting the recognition letter from the Ministry would be a time consuming exercise for the administration. We were told that the letter was sought only for record purpose and has no other intention.

The Chief Commissioner told the delegates that he has not looked into various issues as he has been taken charge recently. We informed the Chief Commissioner that further points would be taken up for consideration during the next meeting.
The matter of regularisation of Stenographers to Inspectors promoted on ad hoc basis was not discussed with the Chief Commissioner personally, due to paucity of time. However consequently we had given a written submission to the Chief Commissioner for favourable action.
